Faces death penalty if convicted of first degree murder.
A Florida man is being held without bond in the Hillsborough County (Fla) jail charged with first degree murder in the death of a four-month old baby boy. Sheriff deputies allege Richard T. McTear, Jr., 21, of Tampa, attacked his teenaged ex-girlfriend, snatched away her infant son, slammed him to the concrete sidewalk before driving away with him. He is not the child’s father. He is accused of tossing the baby out of his Chevrolet Impala’s window while speeding along I-275 near Tampa causing its death.
A TV cameraman, on his way to work, found the body in the pre-dawn hours thinking at first it was a doll. He alerted authorities who, five hours later found McTear at his Tampa home. He was captured following a short foot chase.
No stranger to police, the 21-year- old has 17 felonies on his rap sheet going back to when he was only 14 when he was arrested for felony domestic battery. The most recent charges include burglary with battery, felony battery, aggravated child abuse, kidnap and first degree murder. Prosecutors will seek the death penalty upon conviction. No trial date has been set. McTear has declared his innocence.
Ironically, his ex-girlfriend had filed for a restraining order against McTear that would have ordered him to stay more than 500 feet away from her and the baby. However, the day before the incident she failed to appear for that hearing and the injunction was never activated.

Oh my god!! What is wrong with people?
It seems like the most violent of people keep getting out of jail to cause more violence, while some people who commit NON violent crimes, sit in prison for years. Our criminal justice system is so backwards. This is an angry and dangerous man. He needed HELP when he was 14. If he would had gotten it back then, maybe he would not had become a menis to society. How anyone in their right mind would do that to a tiny innocent baby, is insane.
The man no doubt is a psychopath. He should have been shut up in an asylum years back
What he did is horrible! He definitely deserves the death penalty!
The restraining order most likely wouldn’t have mattered anyway. If he was going to do it anyway a restraining order is nothing but words on paper. I agree some people really do deserve the death penalty when the charges are so cut and dry. This is why I rarely watch the news.
People are sick. I wonder if she did not show up because:
A. She saw him and felt threatened
B. He already had her confined
C. He convinced her that harm would come to her or her child if she did.
D. The classic “Oh baby, I’m so sorry. It will never happen again.”
Giving the death penalty and actually enforcing it..
yeah, I won’t hold my breathe.
Public Hangings have never been taken off the books but they do not do them anymore, maybe they should.

Thsi is really terrible and I agree he had to be mentally ill to have done something so horrific. Pity that he didnt get helpwhen he most needed it
